Terms of Service
IGONGGONGI(2002) (hereinafter the "Company") sets forth the following terms regarding the rights, obligations, and responsibilities between the Company and users in connection with the sale and use of digital content products provided through the website pestolovesyou.com (hereinafter the "Service").
Article 1 (Purpose)
These Terms govern the conditions and procedures for using the Service, the rights, obligations, and responsibilities of the Company and users, and other necessary matters.
Article 2 (Definitions)
- "Service" means any service through which the Company generates and provides personalized digital results based on information and photos provided by the user.
- "User" means a person who agrees to these Terms and uses the Service.
- "Order" means the process by which a user selects a product on the Service, enters the required information, and completes payment.
- "Result" means the digital content (such as a report viewed on the Service) generated and provided by the Company based on information and photos provided by the user.
- Terms not defined herein follow relevant laws and general commercial practice.
Article 3 (Effect and Amendment of Terms)
- These Terms take effect by being posted on the Service's initial screen or a linked screen.
- The Company may amend these Terms within the scope that does not violate applicable laws, including the Act on Consumer Protection in Electronic Commerce and the Act on Regulation of Terms and Conditions.
- When amending these Terms, the Company will announce the effective date and reason for the amendment within the Service at least 7 days before the effective date. However, if the amendment is unfavorable or material to users, the Company will announce it at least 30 days in advance.
- If a user does not express refusal before the effective date of the amended Terms, the user is deemed to have agreed to the amended Terms.
Article 4 (Notification)
The Company may notify users via an in-service notice or the email address entered at the time of order. Matters that materially affect a user's rights or obligations regarding orders and payment will be individually notified by email.
Article 5 (Eligibility)
- The Service is available only to users who are 18 or older. Before uploading photos, users must confirm that they meet this requirement.
- If a person who is a minor under the law of their country uses a paid service without the consent of a legal guardian, the user or the legal guardian may cancel the contract under applicable law.
- If the Company's photo check indicates that a person in an uploaded photo may be a minor, the Company will not process the photo until it has been reviewed, and may cancel and refund the order.
Article 6 (Provision of Service)
- The Company generates and provides a Result based on the photos uploaded by the user and the answers and other information entered at the time of order.
- The Company prepares Results with the help of automated analysis and writing tools, including AI provided by Anthropic, PBC, which analyze the user's photos and answers to describe features relevant to styling. The Company may review a Result before it is delivered. The user's photos are not included in the Result. A Result is styling guidance, not a professional, medical, or cosmetic assessment; if the user believes a Result contains an error, the user may contact the Company to have it reviewed.
- For orders that the Company determines are placed from mainland China, the Result is prepared by the Company's staff without automated analysis or AI tools.
- A Result is produced within 2 days after the Company has received all of the user's photos and answers. Time spent waiting for the user to replace a photo under Article 6-2, or for a manual review of photos flagged by the photo check, is not included. Once complete, the user may view it within the Service by logging in as a guest (order number, name, and email) and using the order status page. The Result remains viewable for 1 month from its completion date, after which viewing access is restricted.
- The Company may change or suspend all or part of the Service for operational or technical reasons, and will provide advance notice in such cases. However, notice may be given afterward if there is an urgent reason.
Article 6-2 (Photo Uploads and Photo Check)
- Users may upload only photos of themselves, in the photo slots provided by the Service. Users may not upload photos that contain nudity or sexually explicit content, violence, abusive or hateful content, photos of another person, or images they do not have the right to use.
- Users may optionally add up to three images of looks they like ("style reference images"). They are used only to understand the user's preferences for the user's own Result, are never shown to anyone else, are checked under the same content rules, and are deleted on the same schedule as the user's photos.
- The Company checks uploaded photos before generating a Result. If a photo does not meet these rules, the Company will not process it; the Company may ask the user for a different photo, or cancel and refund the order, and will delete the photo.
- Uploaded photos are deleted as set out in the Privacy Policy.
Article 7 (Prohibited Conduct)
Users must not engage in any of the following acts in connection with the use of the Service.
- Impersonating another person or entering false information to place an order
- Uploading photos or images in violation of Article 6-2
- Accessing or attempting to access the Company's systems through unauthorized means
- Reproducing, distributing, transmitting, or selling a Result without authorization, or reusing it for commercial purposes
- Violating applicable laws or these Terms
Article 8 (Rights in the Result)
- Copyright and other intellectual property rights in a Result belong to the Company.
- After payment is completed, the user is granted a license to view the Result on the Service for personal use.
- Users may not use a Result for commercial purposes or sell or distribute it to third parties without the Company's prior consent.
Article 9 (Nature of the Result and Disclaimer)
- A Result is interpretive styling content based on the photos and information provided by the user, provided for reference purposes.
- A Result does not substitute for medical, legal, or financial advice, and the Company does not guarantee the accuracy or completeness of its content.
- The Company is not responsible for errors in a Result arising from photos or information provided by the user that are false or inaccurate.
- To the extent permitted by law, the Company is not liable for a user's decisions made in reliance on a Result, or for any resulting damages.
Article 10 (Payment)
Payment for the Service is made through the payment system provided by Toss Payments Corporation (card payments, and PayPal for payments in US dollars) or, where it is offered at checkout, through Paddle or Dodo Payments, and the related procedures follow the policies of the payment provider used. The Company does not directly store payment method information such as card or PayPal account details; such information is managed by Toss Payments, PayPal, Paddle, or Dodo Payments.
Orders paid through Paddle are sold by Paddle.com Market Limited, which acts as our online reseller and the Merchant of Record for those orders. For these orders, Paddle processes the payment, issues the receipt, handles payment-related customer service, and processes refunds, and Paddle's Buyer Terms (https://www.paddle.com/legal/buyer-terms) also apply. The Company remains responsible for providing the Service and the Result.
Orders paid through Dodo Payments are sold by Dodo Payments Inc. (together with its affiliates, "Dodo Payments"), which acts as our online reseller and the Merchant of Record for those orders. For these orders, Dodo Payments processes the payment, calculates and collects any sales tax, VAT or GST, issues the receipt, and carries out refunds, and Dodo Payments' Buyer Terms (https://dodopayments.com/legal/buyer-terms) also apply. The Company remains responsible for providing the Service and the Result.
Article 11 (Withdrawal and Refunds)
- Users may request a refund only if they have not viewed their Result, within 14 days of the order date. Refund requests are submitted by logging in as a guest (order number, name, and email) and using the order status page within the Service. For orders paid through Paddle, users may also request a refund from Paddle directly (paddle.net).
- The Company will review a refund request within 3 business days of receipt and notify the user of approval or rejection.
- Under Article 21 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, once a user has viewed the Result even once, content provision is deemed to have begun and the right of withdrawal is restricted.
- The Result is intangible digital content provided in full the moment it is viewed; because it cannot be partially viewed or used, no partial refunds are available.
- Notwithstanding the foregoing, a refund may still be requested after viewing if the Result's content is materially different from what was advertised, or if normal service provision becomes impossible due to a cause attributable to the Company.
- Upon approval, the Company will process the refund to the original payment method (orders paid through Paddle are refunded by Paddle, and orders paid through Dodo Payments by Dodo Payments); actual receipt may take several business days depending on the payment processor.
Article 12 (Cancellation and Expiration of Orders)
If a user does not complete information entry or payment within a certain period, the Company may treat the order as expired without separate notice.
Article 13 (Disclaimer)
- The Company is not liable for failure to provide the Service due to force majeure, communication failure, server failure, power outage, or other causes beyond the Company's reasonable control.
- The Company is not liable for service disruptions caused by reasons attributable to the user.
Article 14 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Republic of Korea. Any dispute between the Company and a user relating to use of the Service will be brought before the court of competent jurisdiction under the Civil Procedure Act.
